Welcome to kirā Skincare. "We", "us" and "our" refer to kirā Skincare. kirā Skincare operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a shopping experience (the "Services"). kirā Skincare is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced in them (these "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. Nothing in these Terms limits or excludes your statutory rights as a consumer under Belgian or EU law. Where any provision of these Terms conflicts with those rights, your statutory rights prevail.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and account

By agreeing to these Terms you confirm that you are of legal age, or that you have permission from a parent or guardian to use the Services.

To use the Services you may be asked to provide certain information, such as your email address and your billing, payment and delivery details. You confirm that the information you provide is correct, current and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for activity carried out through your account, except where that activity is not attributable to you. You may not transfer, sell or licence your account to anyone else.

2. Our products

We make every effort to represent our products accurately. Colours and appearance may differ on your screen depending on your device and its settings. This does not affect your statutory rights if a product is not as described.

Product descriptions may change. We may discontinue a product or limit the quantities we offer to any person or region.

Our products are cosmetics, not medicines. They are not intended to diagnose, treat, cure or prevent any disease or skin condition. If you have a skin condition or are unsure whether a product is suitable for you, please speak to a doctor or pharmacist.

3. Orders

When you place an order, you are making an offer to purchase. We may accept or decline an order. Your order is accepted when we confirm acceptance, normally by email. We must receive your payment before we accept your order.

Please review your order carefully before submitting it, as we may be unable to change or cancel it once accepted. This does not affect your statutory right of withdrawal, described in our Refund Policy.

If we do not accept, change or cancel an order, we will contact you using the email address, billing address or phone number you provided.

Returns and exchanges are handled in accordance with our Refund Policy and with your statutory rights.

You confirm that your purchases are for your own personal or household use and not for commercial resale or export.

4. Prices and payment

Prices, discounts and promotions may change. The price we charge is the price in effect when you place your order, as set out in your order confirmation. All prices displayed to consumers include VAT. Delivery costs are shown separately at checkout before you complete your order.

Prices on our website may differ from prices offered elsewhere. We may run promotions with their own terms; where those conflict with these Terms, the promotion terms apply to that promotion.

You agree to provide current, complete and accurate purchase, payment and account information, and to keep it up to date so that we can complete your order and contact you.

You confirm that the payment details you provide are accurate, that you are authorised to use the payment method, and that you will pay the amounts charged at the displayed prices, including delivery costs.

5. Shipping and delivery

Delivery times shown on our website are estimates. Unless we agree otherwise with you, we will deliver within 30 days of your order at the latest. If we cannot meet an agreed delivery date and you have made clear that timely delivery was essential, or if we fail to deliver within an additional reasonable period you set, you may cancel the order and receive a full refund.

Risk of loss or damage passes to you when the goods are physically delivered to you or to a person you nominate. If your parcel is lost or damaged in transit, we will send a replacement or refund you.

6. Intellectual property

Our Services, including all trademarks, brands, text, images, graphics, product reviews, video and audio, and the design, selection and arrangement of these, are owned by kirā Skincare or our licensors and are protected by copyright, trademark and other intellectual property law.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, store or transmit material from the Services without our prior written consent, except where the law permits you to do so (for example, quotation, parody, or private copying). All rights not expressly granted are reserved.

kirā Skincare's name, logos, product names, designs and slogans are trademarks of kirā Skincare or our licensors. You must not use them without our prior written permission. Shopify's name and logo are trademarks of Shopify. All other names and logos on the Services are trademarks of their respective owners.

7. Optional tools

We may give you access to tools offered by third parties which we do not monitor or control.

These tools are provided "as is" and "as available", without endorsement by us. Your use of them is at your own risk, and we recommend you review the relevant provider's terms. This does not affect our liability under section 17.

We may add new features to the Services in future. These will form part of the Services and are subject to these Terms.

8. Third-party links

The Services may contain links to websites operated by third parties, including embedded third-party functionality. We do not examine or evaluate the content or accuracy of those sites. If you choose to visit them, you do so at your own risk.

Please review the third party's policies before entering into any transaction with them. Complaints or questions about third-party products and services should be directed to that third party.

9. Relationship with Shopify

kirā Skincare is powered by Shopify, which enables us to provide the Services to you. Any sale or purchase you make in our store is made directly with kirā Skincare. Shopify is not a party to that sale and is not responsible for it. This does not affect any rights you have against us, or any rights you may have against Shopify under applicable law.

10. Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy. By using the Services, you confirm that you have read it.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services. Information you submit will be transmitted to and shared with Shopify and with third parties that may be located in other countries. See our Privacy Policy for details.

11. Reviews and feedback

If you submit ideas, suggestions, feedback, reviews, proposals or other content ("Feedback"), you grant us a worldwide, royalty-free licence to use, reproduce, adapt, publish, distribute and display that Feedback in any medium, including for commercial purposes such as operating, evaluating, improving and promoting the Services.

You may withdraw this licence for future use by contacting us; we are not obliged to remove Feedback already published where doing so is unreasonable, and we may keep copies where we need them to comply with a legal obligation or to defend a legal claim. Your moral rights as an author are unaffected.

You confirm that: (i) you own or have the necessary rights to your Feedback; (ii) you have disclosed any payment or incentive you received in connection with it; and (iii) your Feedback complies with these Terms. We are not obliged to keep Feedback confidential, to pay for it, or to respond to it.

We may, but need not, edit or remove Feedback that we reasonably consider unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that infringes anyone's rights or these Terms. If we remove your Feedback, we will tell you why on request.

Your Feedback must not infringe anyone's rights, contain unlawful, abusive or obscene material, or contain viruses or other malicious code. You may not use a false email address or pretend to be someone else. You are responsible for the Feedback you submit and its accuracy.

12. Errors, inaccuracies and omissions

Occasionally the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, delivery charges, transit times or availability. We may correct these and update the information at any time.

If an accepted order was priced incorrectly and the error was so obvious that you could reasonably have recognised it as a mistake, we may cancel the order and refund you in full without delay. Otherwise, once we have accepted your order we will honour the price shown.

13. Prohibited uses

You may use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to breach any applicable law or regulation; (c) to infringe our intellectual property rights or those of others; (d) to harass, abuse, insult, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to send, upload or re-use material that does not comply with these Terms; (g) to send advertising or promotional material, junk mail, chain letters or spam; (h) to impersonate any other person or entity; or (i) to engage in conduct that restricts or inhibits anyone else's use of the Services.

You also agree not to: (a) upload or transmit viruses or other malicious code; (b) reproduce, copy, extract, sell, resell or exploit any part of the Services; (c) collect or track other people's personal information; (d) spam, phish, pharm or pretext the Services; (e) use robots, spiders, scraping or data-extraction tools, AI tools (including agentic AI) or other automated means to access the Services; or (f) interfere with, bypass or circumvent our security measures, robot exclusion headers, or other measures restricting access.

If you breach these Terms, we may suspend or close your account. Where reasonably possible we will notify you first and give you an opportunity to put things right, unless the breach is serious or urgent action is needed. Suspension does not affect orders we have already accepted.

14. Agents

14.1 This section applies if you use, allow, enable or cause the deployment of an Agent to access, use or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or organisation, and that can run on that person's behalf or using their device without direct supervision.

14.2 An Agent may only access, use or interact with the Services if it identifies itself at all times and complies strictly with section 14.4. No Agent may access the Services if we have asked it to stop.

14.3 We may limit, including by technical means, whether and how any Agent accesses, uses or interacts with the Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request comes from an Agent and disclose its name in the user agent string, in the form "Agent/[agent name]"; (ii) not conceal or obfuscate that access is from an Agent, for example by mimicking human behaviour or by completing or circumventing CAPTCHAs; (iii) respond truthfully to any question seeking to determine whether interactions come from a human or a computer; and (iv) not circumvent any measure intended to block, limit or control how Agents access the Services.

15. Termination

We may terminate this agreement or your access to the Services where you have breached these Terms, or on reasonable notice for other legitimate reasons. Amounts you owe at the date of termination remain payable. Termination does not affect orders we have already accepted, which we will fulfil, nor your statutory rights in relation to products you have already bought.

The following sections continue to apply after termination: Intellectual property, Reviews and feedback, Termination, Warranty, Liability, Severability, Waiver and entire agreement, Assignment, Governing law, Privacy, and any other provision that by its nature should survive.

16. Warranty

As a consumer you benefit from the legal guarantee of conformity. If a product does not conform to the contract, you are entitled to have it repaired or replaced, or to a price reduction or cancellation of the purchase, in accordance with the law. This guarantee applies for two years from delivery and cannot be excluded or limited by these Terms.

Cosmetic products also carry a period-after-opening or best-before indication on the packaging. Please observe it.

Information published on our website is provided for general information purposes. Beyond the legal guarantee, we do not warrant that this information is complete or error-free, or that the Services will be uninterrupted or fault-free.

17. Liability

We are liable for loss or damage caused by our fault or negligence, in accordance with Belgian law.

We do not exclude or limit our liability for: death or personal injury; fraud, intent or gross negligence; liability under product liability law; breach of the legal guarantee of conformity; or any other liability that cannot be excluded or limited by law.

Subject to the above, we are not liable for indirect or consequential loss such as loss of profit, loss of revenue or loss of data, to the extent the law permits us to exclude it.

18. Indemnity (business users only)

If you use the Services for purposes relating to your trade, business, craft or profession, you agree to indemnify us against losses, damages, liabilities and claims, including reasonable legal fees, arising from your breach of these Terms, your breach of any law or third-party right, or your use of the Services.

We will notify you of any claim covered by this section. We may conduct the defence and settlement of the claim at your expense, but will not settle a claim imposing non-monetary obligations on you without your consent, which you may not unreasonably withhold. You will cooperate in the defence, including by providing relevant documents.

This section does not apply to consumers.

19. Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision will apply to the fullest extent the law permits, and the unenforceable part will be treated as removed. This does not affect the validity of the remaining provisions.

20. Waiver and entire agreement

If we do not exercise or enforce a right or provision under these Terms, that does not amount to a waiver of it.

These Terms, together with the policies published on this website, form the entire agreement between you and us regarding your use of the Services, and replace any earlier agreements or communications on the subject. This does not exclude liability for anything we have told you fraudulently or misleadingly.

21. Assignment

You may not transfer or assign these Terms or your rights and obligations under them without our prior written consent.

We may transfer or assign these Terms and our rights and obligations, provided this does not reduce any guarantee or right you have as a consumer. We will tell you in advance if we do.

22. Governing law and disputes

These Terms and any agreement under which we provide you the Services are governed by Belgian law.

If you are a consumer resident in another EU member state, you keep the protection of the mandatory rules of the law of your own country.

Disputes may be brought before the competent Belgian courts, without prejudice to your right as a consumer to bring proceedings in the courts of your place of residence.

If you have a complaint we cannot resolve together, you may use the European ODR platform at https://ec.europa.eu/consumers/odr, or contact the Belgian Consumer Ombudsman Service, Koning Albert II-laan 8 box 1, 1000 Brussels.

23. Headings

Headings are included for convenience only and do not affect the interpretation of these Terms.

24. Changes to these Terms

You can always find the current version of these Terms on this page.

We may update these Terms. Changes apply only to orders placed after the change takes effect, and never retrospectively to orders we have already accepted. We will give notice of material changes as required by law.
